Terms of Service

1. Agreement to Terms

By accessing or using the services provided by ETREND ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

These Terms apply to all visitors, users, and others who access or use our services, including but not limited to web design, YouTube management, Facebook management, and logo design.

2. Description of Services

ETREND offers the following digital services:

  • Web Design: Custom website design and development including mobile-responsive layouts, SEO optimization, and deployment.
  • YouTube Management: Channel strategy, content planning, video SEO, thumbnail design, upload scheduling, and analytics reporting.
  • Facebook Management: Content creation, scheduling, community management, advertising campaigns, and monthly performance reports.
  • Logo Design: Brand identity design including multiple concept presentations, revisions, and delivery of final files in all standard formats.

The exact scope of services will be defined in a separate Statement of Work or project proposal agreed upon by both parties prior to commencement.

3. Payment Terms

All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's Services Agreement and Privacy Policy.

  • Payment is due in full or as per the agreed payment schedule before work begins, unless otherwise specified in writing.
  • For ongoing monthly services (e.g., YouTube or Facebook management), payments are billed on a recurring monthly basis.
  • All prices are listed in USD unless otherwise stated.
  • We reserve the right to suspend services if payment is not received within 7 days of the due date.

4. Refund Policy

Due to the custom and time-sensitive nature of digital services, all sales are generally final. However:

  • If work has not commenced within 7 days of payment, a full refund may be requested.
  • Partial refunds may be issued at our discretion for work that has been partially completed.
  • No refunds will be issued once a project has been completed and delivered to the client.
  • For monthly subscription services, cancellations must be made at least 5 business days before the next billing cycle to avoid being charged.
  • Stripe's dispute resolution policies apply for any payment disputes initiated through Stripe.

5. Intellectual Property

Upon receipt of full payment, ETREND transfers ownership of the final deliverables (e.g., website files, logo designs) to the client. We retain the right to:

  • Display completed work in our portfolio and marketing materials unless the client requests otherwise in writing.
  • Retain ownership of any pre-existing tools, frameworks, templates, or proprietary processes used during project execution.

You represent and warrant that any content, materials, or assets you provide to us for use in your project do not infringe upon the intellectual property rights of any third party.

6. Client Responsibilities

To ensure timely delivery, you agree to:

  • Provide necessary content, assets, and access credentials in a timely manner.
  • Respond to feedback requests within 5 business days to avoid project delays.
  • Ensure all materials provided are legally owned or licensed by you.

7. Limitation of Liability

To the fullest extent permitted by applicable law, ETREND shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability shall not exceed the total fees paid by you for the specific service giving rise to the claim.

8. Termination

Either party may terminate a service agreement with 14 days' written notice. Upon termination:

  • You will be billed for all work completed up to the termination date.
  • All deliverables completed and paid for will be transferred to you.
  • Any recurring billing will be cancelled effective the end of the current billing period.

9. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to binding arbitration.

10. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "last updated" date. Your continued use of our services after changes constitutes acceptance of the revised Terms.
